Terms of Use
This is the agreement between you and MORPH. By using the app you accept it. If you do not, do not use the app.
How this fits with Apple's terms. MORPH is licensed to you under Apple's Licensed Application End User License Agreement, which applies in full and is incorporated here by reference.
This document does not replace it. It adds the things Apple's standard terms do not cover, because they are written for apps in general and MORPH gives people numbers about their own bodies: what MORPH is not, why every figure in it is an estimate, and how the Challenger feature works. Where the two ever conflict on a point Apple's agreement covers, Apple's wins.
What MORPH is
A habit app built around four daily items: drinking water, walking, keeping an eating window, and logging your meals. It derives one daily calorie target and one eating window from what you tell it about your body and your sleep, and it lets one person you choose see whether you completed each item.
What MORPH is not
MORPH is not a medical service, and nothing in it is medical advice. The calorie target, the protein target, the eating window and the weight projection are estimates produced by standard published formulas. No clinician has reviewed them.
Do not use MORPH in place of talking to a doctor. Talk to one before changing how you eat if you are pregnant, breastfeeding, recently gave birth, are under 18, have an eating disorder or a history of one, take medication that affects appetite or blood sugar, or have any condition affected by diet.
MORPH refuses to set a weight-loss target in several of those situations. That refusal is a safety floor, not clearance to proceed in the others.
Estimates are estimates
The calorie target, the projected goal date and the meal-photo estimates are approximations, and they can be wrong. The scanner in particular estimates from a photograph, and a flat image cannot determine portion size reliably; MORPH deliberately shows a range rather than a single number for that reason. Do not treat any figure in the app as measured.
Who can use it
You must be 18 or over. MORPH is not offered to children.
Your account
You may use MORPH without an account. If you create one, keep it secure and do not share it, and do not use anyone else's. You can delete your account at any time from Profile; deletion is immediate, permanent and cannot be reversed by anyone, including us.
Subscriptions
[No subscription is offered yet. Before a paywall ships, this section must state: what the subscription includes, the price and the billing period, that it renews automatically until cancelled, that cancellation is done through the App Store at least 24 hours before the period ends, and that Apple handles all billing and refunds. Apple requires these disclosures and rejects paywalls without them.]
Acceptable use
Do not attempt to break, overload, probe or reverse-engineer the service; do not use it to harm anyone; and do not use another person's account. MORPH limits how many photo scans an account may make in a day, and working around that limit is not permitted.
The Challenger feature
If you link an accountability partner you are choosing to show them whether you completed each of the four daily items, and your streak. Only link someone you are content to have see that. Either of you can end the link at any time. You are responsible for who you invite.
Availability
MORPH is provided as-is and as-available. Features can change or be withdrawn, and the service can be interrupted. Your daily record is stored on your device as well as on the server, so it survives an outage of ours.
Your content
What you put into MORPH stays yours. You grant MORPH only the permission needed to run the service for you — storing your record, syncing it to your other devices, and, if you turn the scanner on and consent to it, passing a meal photo to the provider that estimates it. That permission ends when you delete your account.
Liability
[Needs a lawyer. A health-adjacent app that outputs calorie targets has a different risk profile from a to-do list, and boilerplate copied from a SaaS template is the wrong instrument here. This section should be written for this product, not pasted.]
Apple
These added terms are between you and MORPH only. Apple is not a party to them, and the points below restate the parts of Apple's agreement that people most often need pointed out — they are not a replacement for it.
- Your licence to use MORPH is a non-transferable licence to run it on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for MORPH. Support requests go to support@morph-me.com.
- If MORPH fails to conform to any warranty that applies, you may tell Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation in respect of MORPH.
- MORPH, not Apple, is responsible for any claim relating to the app — including product liability, any failure to conform to a legal or regulatory requirement, claims under consumer protection or similar law, and any claim that the app infringes someone's intellectual property.
- You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and have the right to enforce them against you.
Governing law
[JURISDICTION — to be set with the legal entity.] Nothing here removes consumer rights that the law of your own country gives you and does not permit you to waive.
Changes
These terms can change. Material changes will be shown in the app before they take effect, and the effective date at the top always reflects the current version.
